These Terms of Service ("Terms") govern the legal relationship between YASYN Technologies ("Company", "we", "us"), located at Dordrecht, The Netherlands, and the user ("User", "you") regarding the use of the Mentionly software service. By accessing or using the Service, you agree to be bound by these Terms.
Mentionly is a data aggregation tool that monitors public content on third-party platforms based on user-defined keywords. The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
The functionality of Mentionly depends entirely on the availability and accessibility of data from third-party platforms (including, but not limited to, Reddit, Hacker News, and Lobsters).
You acknowledge and agree that YASYN Technologies has no control over these third-party platforms. If a platform restricts access, modifies its API, blocks our scraping infrastructure, or ceases operations, YASYN Technologies shall not be held liable for any resulting interruption or termination of data delivery. Such interruptions are considered force majeure and do not constitute a breach of this agreement.
Lifetime Deal Definition: References to "Lifetime" access refer to the lifetime of the Mentionly product, not the lifetime of the purchaser. In the event that YASYN Technologies decides to discontinue the Mentionly product, we will endeavor to provide a 30-day notice period. No refunds will be issued upon discontinuation after the initial guarantee period has expired.
Refund Policy: We offer a 14-day money-back guarantee. If you are not satisfied with the Service for any reason, you may request a full refund within 14 days of the original purchase date by contacting info@yasyn.nl. After this period, all sales are final.
To the maximum extent permitted by applicable law, YASYN Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of sales or leads, business interruption, or loss of data.
Specifically, YASYN Technologies does not guarantee that the Service will capture every relevant mention or lead on the internet. The total liability of YASYN Technologies for any claim arising out of or relating to these Terms or the use of the Service shall not exceed the amount paid by you to the Company for the Service.
You agree not to misuse the Service. Specifically, you may not use Mentionly to: (i) reverse engineer the application; (ii) scrape data for the purpose of creating a competing service; or (iii) resell the data provided by the Service. Violation of these terms may result in immediate termination of your account without refund.
These Terms shall be governed by and construed in accordance with the laws of The Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the district where YASYN Technologies is registered.
